EULA | End User License Agreement
THIS IS A LEGAL AGREEMENT, by downloading and/or installing Carlos Fabian Camargo Guerrero Font software you agree to the following terms:
1. This License is for the benefit of a single user only. A single user is permitted to install and use the font software on one (1) portable device such as a notebook or laptop computer and on one (1) desktop or workstation type device that remains at a single location. This computer can be connected to any number of output devices, such as laser printers, ink jet printers, an image setter or a film recorder. The font software may be downloaded to the memory (hard disk or RAM) of the output devices that are customarily used by you for the purposes of having such font software remain resident in the output devices. If you need to install the Font Software on more than the one (1) computer, as identified above, or more users need to use the font software, you are required to purchase additional licenses. You further agree to treat the software as confidential information and exercise reasonable care to avoid unauthorized distribution of the Font Software. If you cannot or do not agree to the terms of this license, return the software unused to Carlos Fabian Camargo Guerrero, carlosfabiancg@andinistas.net, Bogotá, Colombia.
2. The Font Software is the exclusive property of Carlos Fabian Camargo Guerrero. This non-exclusive and revocable license grants you certain limited rights to use the font software only. All other right, title and interest in and to the font software, together with the design of the fonts embodied therein together with the trademarks, trade names and service marks are the exclusive property of Carlos Fabian Camargo Guerrero.
3. Except as may be otherwise expressly permitted herein or by a separate written agreement, you may not modify, adapt, translate, reverse engineer, decompile, disassemble, alter or otherwise copy the Carlos Fabian Camargo Guerrero Font Software or the designs embodied therein. You are permitted to make a single back-up copy. The Carlos Fabian Camargo Guerrero Font Software or documentation may not be sublicensed, sold, leased, rented, lent, or given away to another person or business.
4. The Font Software may be returned or exchanged only if defective and will be replaced only when accompanied by a valid sales receipt within four (4) weeks of purchase.
5. You agree that any derivative typeface font software created by you which uses, incorporates or is otherwise based upon the design of the Fonts or otherwise incorporate any of the Carlos Fabian Camargo Guerrero Font Software, including, but not limited to, software, EPS files, or other electronic works, are considered derivative works under the Law of the Republic of Colombia and use of any derivative work is the property of Carlos Fabian Camargo Guerrero and shall be subject to the terms and conditions of this License. Derivative works may not be sublicensed, sold, leased, rented, lent, or given away without the express written permission of Carlos Fabian Camargo Guerrero. Carlos Fabian Camargo Guerrero shall not be responsible for unauthorised, modified and/or regenerated software or derivative works. You are permitted to convert the Fonts to outline or bitmap images for the purposes of publishing electronic documents.
6. If you are an advertising agency, acting on behalf of an advertising agency or otherwise acting in a similar capacity or for the benefit of a third party, the purchase of a license for your client is required and, depending upon how the Font Software will be used, an additional license upgrade and/or the purchase of a special license may be also be required. A special license is required to use the Font Software with or in alphabet products such as scrapbook products or software, adhesive or rub-on lettering, electronic books, game playing devices, gaming or gambling devices irrespective of whether the Font Software itself is embedded into the device or if it is merely the designs of the Fonts that are displayed. If you are using the Font Software in cinema, motion pictures, on television or on cable television, in Quicktime or Flash movies or other animations broadcast on the Internet, a special license is required and an additional license fee may be required. The terms of this Agreement are contractual in nature.
7. The embedding of Carlos Fabian Camargo Guerrero Font Software in PDF documents or in Flash documents is allowed provided that the extraction of the Fonts is prohibited. Notwithstanding this, embedding of the Carlos Fabian Camargo Guerrero Font Software in other software or devices or in any other form whatsoever requires the purchase of and shall be governed by a separate license agreement.
8. The Carlos Fabian Camargo Guerrero Font Software is protected under domestic and international trademark, copyright and industrial design law. You may, but are not required to, identify Carlos Fabian Camargo Guerrero fonts and ownership in any design and/or production credits.
9. Any breach of the terms of this Agreement shall be cause for termination. In the event of termination, and without limitation of any remedies under law or equity, if applicable, you agree to immediately return the Font Software to Carlos Fabian Camargo Guerrero and certify that no copy remains in your possession or control.
10. You may transfer the Font Software to another party provided that the new licensee agrees, in writing, to be bound by this License and you destroy all copies of the Font Software immediately upon transfer of the Font Software. The new Licensee must transmit a copy of their Agreement to Carlos Fabian Camargo Guerrero.
11. Carlos Fabian Camargo Guerrero MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE. THE FONT SOFTWARE WAS NOT MANUFACTURED FOR USE IN MANUFACTURING CONTROL DEVICES OR NAVIGATION DEVICES OR IN CIRCUMSTANCES THAT COULD RESULT IN ENVIRONMENTAL DAMAGE OR PERSONAL INJURY. WITHOUT LIMITING THE FOREGOING, Carlos Fabian Camargo Guerrero SHALL IN NO EVENT BE LIABLE TO THE LICENSED USER OR ANY OTHER THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING DAMAGES FROM LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, ARISING OUT OF THE USE OR INABILITY TO USE THE PRODUCT EVEN IF NOTIFIED IN ADVANCE. UNDER NO CIRCUMSTANCES SHALL Carlos Fabian Camargo Guerrero´ LIABILITY EXCEED THE REPLACEMENT COST OF THE SOFTWARE, whichever is less, and at the sole discretion of Carlos Fabian Camargo Guerrero.
The Carlos Fabian Camargo Guerrero Font Software End User License Agreement is subject to Colombian Law. By downloading and installing the Fonts, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this License Agreement.
ESTE ES UN ACUERDO LEGAL, al descargar y / o instalar el software de fuentes tipográficas de Carlos Fabián Camargo Guerrero usted acepta los siguientes términos:
1. Esta licencia es para el beneficio de un único usuario. Se permite que un solo usuario instale y use el software de fuentes en un (1) dispositivo portátil, como una computadora portátil o computadora portátil, y en un (1) dispositivo de escritorio o estación de trabajo que permanece en una sola ubicación. Esta computadora se puede conectar a cualquier cantidad de dispositivos de salida, como impresoras láser, impresoras de chorro de tinta, una grabadora de imágenes o una grabadora de películas. El software de fuentes puede descargarse a la memoria (disco duro o RAM) de los dispositivos de salida que usted utiliza habitualmente con el fin de que dicho software de fuentes permanezca residente en los dispositivos de salida. Si necesita instalar el software de fuentes en más de una (1) computadora, como se identificó anteriormente, o más usuarios necesitan emplear el software de fuentes, debe comprar licencias adicionales. Además, acepta tratar el software como información confidencial y ejercer un cuidado razonable para evitar la distribución no autorizada del Software de fuentes. Si no puede o no está de acuerdo con los términos de esta licencia, devuelva el software sin usar a Carlos Fabián Camargo Guerrero, carlosfabiancg@andinistas.net, Bogotá, Colombia.
2. El Software de Fuentes es propiedad exclusiva de Carlos Fabián Camargo Guerrero. Esta licencia no exclusiva y revocable le otorga ciertos derechos limitados para emplear únicamente el software de fuentes. Todos los demás derechos, títulos e intereses sobre el software de fuentes, junto con el diseño de las fuentes incorporadas en el mismo junto con las marcas registradas, nombres comerciales y marcas de servicio son propiedad exclusiva de Carlos Fabián Camargo Guerrero.
3. Salvo que se permita expresamente lo contrario en el presente o mediante un acuerdo por escrito separado, no puede modificar, adaptar, traducir, realizar ingeniería inversa, descompilar, desensamblar, alterar o copiar de otra manera el Software de fuentes Carlos Fabián Camargo Guerrero o los diseños incluidos en el mismo. Se le permite hacer una única copia de seguridad. El software de fuentes Carlos Fabián Camargo Guerrero o la documentación no se puede sub licenciar, vender, arrendar, alquilar, prestar o regalar a otra persona o empresa.
4. El Software de fuentes se puede devolver o cambiar solo si está defectuoso y se reemplazará únicamente cuando esté acompañado de un recibo de venta válido dentro de las cuatro (4) semanas posteriores a la compra.
5. Usted acepta que cualquier software de fuentes tipográficas derivado creado por usted que utilice, incorpore o se base de otro modo en el diseño de las fuentes o incorpore cualquier software de fuentes Carlos Fabián Camargo Guerrero, incluido, entre otros, el software EPS. Los archivos, u otros trabajos electrónicos, se consideran trabajos derivados bajo la Ley de la República de Colombia y el uso de cualquier trabajo derivado es propiedad de Carlos Fabián Camargo Guerrero y estará sujeto a los términos y condiciones de esta Licencia. Las obras derivadas no se pueden sub licenciar, vender, arrendar, alquilar, prestar o regalar sin el permiso expreso por escrito de Carlos Fabián Camargo Guerrero. Carlos Fabián Camargo Guerrero no será responsable por software no autorizado, modificado y / o regenerado o trabajos derivados. Se le permite convertir las fuentes en imágenes de mapa de bits o contornos con el fin de publicar documentos electrónicos.
6. Si usted es una agencia de publicidad, actúa en nombre de una agencia de publicidad o actúa de otra manera en una capacidad similar o en beneficio de un tercero, se requiere la compra de una licencia para su cliente y, dependiendo de cómo el Software de fuentes se utilizará, es posible que también se requiera una actualización de licencia adicional y / o la compra de una licencia especial. Se requiere una licencia especial para usar el Software de fuentes con o en productos alfabéticos, como productos o software de álbumes de recortes, letras adhesivas o para frotar, libros electrónicos, dispositivos de juego, dispositivos de juegos o apuestas, independientemente de si el Software de fuentes en sí está integrado en el dispositivo o si son simplemente los diseños de las fuentes que se muestran. Si está utilizando el software de fuentes en cine, películas, televisión o televisión por cable, en películas QuickTime o Flash u otras animaciones transmitidas por Internet, se requiere una licencia especial y es posible que se requiera una tarifa de licencia adicional. Los términos de este Acuerdo son de naturaleza contractual.
7. Se permite la incrustación de Carlos Fabián Camargo Guerrero Font Software en documentos PDF o en documentos Flash siempre que se prohíba la extracción de las fuentes. Sin perjuicio de esto, la incorporación del software de fuentes Carlos Fabian Camargo Guerrero en otro software o dispositivos o en cualquier otra forma requiere la compra y se regirá por un contrato de licencia por separado.
8. El software de fuentes Carlos Fabián Camargo Guerrero está protegido por las leyes de marcas nacionales e internacionales, derechos de autor y diseño industrial. Puede, pero no está obligado a, identificar las fuentes y la propiedad de Carlos Fabian Camargo Guerrero en cualquier diseño y / o créditos de producción.
9. Cualquier incumplimiento de los términos de este Acuerdo será motivo de rescisión. En caso de rescisión, y sin limitación de cualquier remedio bajo la ley o la equidad, si corresponde, usted acepta devolver inmediatamente el Software de fuentes a Carlos Fabian Camargo Guerrero y certifica que ninguna copia permanece en su posesión o control.
10. Puede transferir el Software de fuentes a otra parte siempre que el nuevo titular de la licencia acepte, por escrito, estar sujeto a esta Licencia y usted destruya todas las copias del Software de fuentes inmediatamente después de la transferencia del Software de fuentes. El nuevo Licenciatario deberá transmitir copia de su Acuerdo a Carlos Fabián Camargo Guerrero.
11. Carlos Fabián Camargo Guerrero, NO OTORGA NINGUNA GARANTÍA, EXPRESA O IMPLÍCITA, EN CUANTO A COMERCIABILIDAD, APTITUD PARA UN PROPÓSITO PARTICULAR O DE OTRO MODO. EL SOFTWARE DE FUENTES NO FUE FABRICADO PARA SU USO EN DISPOSITIVOS DE CONTROL DE FABRICACIÓN O DISPOSITIVOS DE NAVEGACIÓN O EN CIRCUNSTANCIAS QUE PODRÍAN RESULTAR EN DAÑOS AMBIENTALES O LESIONES PERSONALES. SIN LIMITAR LO ANTERIOR, Carlos Fabian Camargo Guerrero EN NINGÚN CASO SERÁ RESPONSABLE ANTE EL USUARIO CON LICENCIA O CUALQUIER OTRO TERCERO POR CUALQUIER DAÑO DIRECTO, INDIRECTO, CONSECUENTE O INCIDENTAL, INCLUYENDO DAÑOS POR PÉRDIDA DE BENEFICIOS COMERCIALES, INTERRUPCIÓN COMERCIAL, PÉRDIDA DE NEGOCIOS. INFORMACIÓN QUE SURJA DEL USO O LA INCAPACIDAD DE UTILIZAR EL PRODUCTO INCLUSO SI SE HA NOTIFICADO CON ANTICIPACIÓN. BAJO NINGUNA CIRCUNSTANCIA LA RESPONSABILIDAD DE Carlos Fabián Camargo Guerrero EXCEDERÁ EL COSTO DE REEMPLAZO DEL SOFTWARE, el que sea menor, ya criterio exclusivo de Carlos Fabián Camargo Guerrero.
El Acuerdo de licencia de usuario final del software de fuentes Carlos Fabián Camargo Guerrero está sujeto a la ley colombiana. Al descargar e instalar las fuentes, reconoce que ha leído, comprendido y aceptado los términos y condiciones de este Acuerdo de licencia.
